Any other Jetix web sites which may be accessed through the Site shall be subject to the terms and conditions governing the use of such web sites.

Ownership and use

1. The Site is owned and operated by Jetix. The material contained on the Site ('the Content') is owned by or licensed to Jetix. It is provided solely for your personal, non-commercial use. This means that you may only view or download material from this Site for your own use. You must keep all copyright and other proprietary notices attached or relating to the downloaded material and you must not modify or alter any Content. The Content is provided free of charge for informational purposes only and does not constitute a business relationship or a representation of any kind.

3. You are also strictly prohibited from creating works or materials that derive from or are based on the Content including, without limitation, fonts, icons, link buttons, wallpaper, desktop themes, on-line postcards and greeting cards, and unlicensed merchandise. This prohibition applies regardless of whether the derivative materials are sold, bartered, or given away.

Unsolicited submissions

4. If unsolicited submissions such as (without limitation) submissions of scripts, story lines, articles, fan fiction, characters, drawings, information, suggestions, ideas, or concepts are sent to Jetix, such submissions become the property of Jetix and may be used, copied, sublicensed, adapted, transmitted, distributed, publicly performed, published, displayed, or deleted as Jetix sees fit in all media throughout the universe in perpetuity.

5. You agree that you are not entitled to any compensation, credit, or notice whatsoever in respect of any material submitted by you and that by sending an unsolicited submission you waive the right to make any claim against Jetix, its parent or affiliated companies relating to unsolicited submissions, including, without limitation, unfair competition, breach of implied contract or breach of confidentiality.

Trade marks and other intellectual property

6. The intellectual property rights in all elements of the Site, including (without limitation) the copyright, database rights, trade marks, patents, know-how, confidential information and collections of personal data, are owned and/or controlled by Jetix unless otherwise stated.

7. All trade marks shown on the Site belong to Jetix or other third party owners. Any unauthorised use of the trade marks is prohibited and, in particular, Jetix's trade marks may not be used:

I. As a hyperlink without our prior written consent;
II. In a non-Jetix product name or publication title;
III. In, as, or as part of your own trade marks; or
IV. In a manner disparaging to Jetix.

Links to non-Jetix web sites

8. Within the Site, you may find links or references to third party materials (including analysts' reports, press releases and stock prices) and web sites outside the Site. A link to a non-Jetix website, even a website that may contain the Jetix logo or other Jetix trade marks, does not mean that Jetix endorses, authorises or controls that website or its content. Jetix is not responsible for and accepts no liability in respect of any third party material or websites or the use or misuse of such materials or websites.

Advertising

9. Jetix is in no way responsible for any advertising messages from third parties that you may see through the Site. The appearance of an advertising message from a third party does not mean that Jetix endorses that third party's products or services, or accepts any responsibility for such products or services or the content of such advertising messages.

Updates

10. Jetix may revise, update or withdraw the Content in whole or in part at any time without notice. Jetix may at any time update, change or modify ('modifications') these Terms of Use by revising this posting. You agree, by using the Site, to be bound by any such modifications as and when those modifications are implemented, regardless of whether you had any notice thereof, and you agree to periodically visit this page to determine the then current Terms of Use by which you are bound.

Privacy

11. It is a condition of your use of the Site that you have read and consented to the terms of the Jetix Privacy. The Jetix European web site network provides sites aimed specifically at children. The use of such sites, and of the Site by persons under the age of 16 is covered by the Jetix Children's Privacy Policy (this is contained in our sites aimed specifically at children).

Career opportunities

12. Jetix may, from time to time, post career opportunities on the Site and/or invite users to submit resumes to it. If you choose to submit your name, contact information, resume and/or other personal information to Jetix, you are authorising Jetix to utilise this information for all lawful and legitimate hiring and employment purposes. Jetix reserves the right, at its sole discretion, to forward the information you submit to it to its parent, subsidiary and affiliated companies for legitimate business purposes subject to the terms of the Jetix Privacy Policy. Nothing in these Terms of Use or contained in the Site shall constitute a promise by Jetix to interview, hire, or employ any individual who submits information to it, nor shall anything in these Terms of Use or contained in the Site constitute a promise that Jetix will review or respond to any or all of the information submitted to it by users.

Disclaimer of liability

13. Jetix makes no representations or warranties (express or implied) and disclaims all liability in respect of the Content and the Site, to the extent permitted by law. Use of the Site and reliance on the Content is at your own risk and any Content you wish to rely on should be independently verified by you. The information contained on the Site, and in particular news, stock quotes, press releases or other messages with regards to Jetix or other companies is not intended for trading or investment purposes. No information contained in the Site constitutes an offer or invitation to invest in securities of Jetix, its parent, subsidiary or affiliated companies or any third party.

14. In particular but without limitation you acknowledge that Jetix, its parent, subsidiary and affiliated companies, together with their respective employees, agents, directors, officers and shareholders, are not liable for any delays, inaccuracies, failures, errors, omissions, interruptions, deletions, defects, viruses, communications line failures, or for the theft, destruction, damage, or unauthorised access to your computer system or network in any case in any connection with the use, misuse or inability to use the Site.

Further and also without limitation you also acknowledge that in no event shall Jetix, its parent, subsidiary and affiliated companies, officers, servants, agents or employees be liable for any direct, consequential or economic loss whatsoever regardless of whether such losses are foreseeable and whether or not caused by Jetix's negligence arising out of or in connection with the use, misuse or inability to use the Site save that nothing contained in these Terms of Use shall limit Jetix's liability for loss or damage arising out of personal injury, death or acts of fraud.

Indemnity

16. You agree to defend, indemnify, and hold harmless Jetix, its parent, subsidiary and affiliated companies together with their respective employees, agents, directors, officers and shareholders, from and against all liabilities, claims, damages and expenses (including legal fees) arising out of your use, misuse or failure to use the Site and the Content.

Termination

17. Jetix reserves the right to immediately terminate your use of, or access to, the Site at any time if Jetix decides at its sole discretion that you have breached these Terms of Use or any relevant law, rule, or regulation, or you have engaged in conduct that Jetix considers, in its discretion, to be inappropriate or unacceptable.

Jurisdiction

18. The Site and the Content are designed for use in the United Kingdom and The Netherlands only. Jetix make no representations that the Content is appropriate for use in other territories. If users reside in other territories, then such users agree that their use of the Site is at their own risk and that they will comply with all applicable laws in their country of residence.

19. Any interpretation, claims or disputes involving these Terms of Use, shall be subject to the exclusive jurisdiction of the English Courts under English Law. Should any provision of these Terms of Use be invalid or unenforceable, that provision shall be given no effect and shall be deemed not to be included in these Terms of Use but without invalidating any of the remaining provisions.
